During a contentious divorce, it is unfortunately not uncommon for both parties to be so caught up in their own struggles and battles against one another that the well-being of the children loses its place as the top priority. In the emotionally heated conflicts of divorce, it is easy to see how some parents may not be able to properly judge what is best for their kids.

While pushing a child’s best interest may not be intentional, the court has a system in place to ensure a child’s welfare is protected: The ability to appoint a legal representative to look out for the child’s best interest in the form of a Guardian Ad Litem (GAL).

A GAL is appointed by the court to act as an independent observer and advocate for the child (ren) in a contested child custody case. The GAL can be either a legal or mental health professional, who is known to the Judge as being knowledgeable in every aspect of child custody and family law issues. The judge charges the GAL to investigate the contested issues, interview the parents and children, (as well as third parties, such as teachers, daycare providers, etc.), and view the child (ren) with each parent in their home environment. The GAL will report back to the judge, usually in writing, with their findings and recommendations. Issues that the GAL may make recommendations on are issues related to custody, parenting time, visitation, or any other contested matter. It is important to note that the GAL does not work for either party, which gives them a neutral standing to make a fair judgment of what will be the best outcome for all children involved.
